This is going to dump out a lot of bogus IP ...
Finally the Patent Office is 'getting it'. Too many people are sick and tired of their products and services being threatened by creative after the fact patents that are designed simply to 'shake down' some deep pockets target(s). The SCO litigation is a prime example of IP abuse that is bound to spread to the patent arena if nothing is done to prevent it.

Patents were intended to protect innovation, but now they are being used to hijack innovations by quietly filing for patents on longstanding public domain practices and designs and then waiting for the right time to pounce on whatever opportunity might present itself. Patents on pre-existing concepts should be bounced like three dollar bills.

Another common tactic is to present a product as being open and not patented and promote its use on the basis of its being free and then lie in wait with patent in hand in case it shows signs of success. It should be a requirement that patent holders defend their patents and present patented technology as patented technology from the beginning. Once they overtly allow it to be freely circulated their rights should be terminated.

Yet another, abuse of course, is the patenting of fantasy concepts that the one filing the patent has no intention of pursuing. This is the done with the hope that some future genuine invention will somehow fall into the trap of fitting into the 'scope' of the fantasy patent to a point that the fantasy patent troll can proceed to collect from a product that he himself never envisioned. Patents should have to be granted only for well defined and viable innovations, not for sweeping illusory concepts.
