you are an interesting critter...
You argue for patents (1 or 3 aspects of Intellectual Property Law) but if either case (patent is enforced against Microsoft, patent is provided for use to the Open Source community) you spout a counter message. Yet, on the other hand, you argue for patents (and software patents) as a force to be used against this software development methedology that you have such a fear of (and the licenses that permit the use of them) and argue that those that do the work on these projects give up all intellectual property rights and place the work in the public domain. I think you are severely confused (or very fearful of the competition).
