APA not a conveyance
Novell never transfered the copyrights as OldSCO never asked for them.

And Kimball already ruled the APA wasn't a conveyance. Now SCO is trying to change their complaint to make Novell transfer the copyrights...the ones they've been claiming all along they already own.

SCO is admitting they don't have the copyrights, which means the tattered remains of the IBM case are dead. It also means SCO had no claim to damages, from anyone. And they might owe Novell many millions of dollars that, right now, they don't have.

It wasn't just that they had a weak case, it means they had no case and any reasonably competent legal council would have told them that. They knew and filed anyway.
