- Desperation for sure along with total legal incompetence ...
- Immediately after Judge Wells rules that Novell DID NOT transfer ALL Unix assets SCO attempts to move the issue to Judge Kimball's court by yet another amendment to there current case. Odds are that Judge Kimball will see through this one and I can all but hear another tongue lashing headed in SCO's direction. There is little doubt in my mind that SCO stock is rising only because SCO's remaining deep pocket investor's continue to throw money into a losing case for no other reason than to inflict damage on their free software competitors. It will be interesting to see where the cards fall when the circus is finally over. I suspect that the precedents set in SCO's suicidal litigation will royally poison the water in terms of future attempts to attack free software. And that is the silver lining to the whole thing. A whole lot of determined SCO investors are going to find that they have trown a whole lot of money at this crusade only to come up empty handed in the end and in fact a whole lot worse off because of the precedents set by this ill advised jihad. They will eventually get their just deserts.
