Variable pricing already exists.

Currently, labels charge a variety of wholesale prices that can range upward of 75 cents per track, industry sources have said. However, it's the retailer, such as Apple, Walmart.com, or RealNetworks, that decides what price individual consumers will pay.

Apple's iPod profits allow the company to retain the $0.99 fixed price, and competitors have to follow Apple's lead.

But the RIAA companies can apparently fine the retailers for non-compliance by making some songs unprofitable to sell, or at least substantially reduce profits.


And the companies do not have to collude in a legally identifiable manner. When there are few suppliers, they can study each other's prces and respond quickly.

That's not illegal, but it's a good sign of the need for regulation, if some legislature were more concerned about consumers than the hardships of life for the content companies.
