The basic fundamental problem is that a computer is dumb. It knows how to move 0's and 1's around. It doesn't know why it was asked to do it, and that's the limitation with technological approaches to the issue. Meanwhile, clumsy and intrusive technologies are proposed and rolled out which interfere with legitimate fair use or attempt to change the way people have always used their music. There is no magic number, Congressman Stearns, like 3 or 5 or 10, for the fair use copies I may require over the lifetime of my ownership and the imposition of counting hacks will potentially deny me a fair use of my purchased item. And, were I looking to infringe commercially, my first copy would be the money copy, right? Content publishers who dial up the nuisance factor, use technology to wall out competing corporations and customer-preferred devices, and who auto-load exploitable and effectively uninstallable software may find themselves with a lot of well-protected items sitting inside warehouses constituting the assets for Chapter 7 proceedings. Well, it's an interesting experiment: using legislation and technology to social engineer the masses. Makes one wonder if these folks don't think about how Prohibition would have succeeded if only there was a chip which turned off the spigot when alcohol above a certain proof was detected. "Ah, we had the legislation, we just didn't have the technology, that's the lesson of the 1920's" they murmur over martinis at the soiree/campaign fundraiser.
