The Problem Is
That the media won't play when the second disk is removed and placed on another machine, due to the DRM mechanism, so the back-up is not effective. This is by design becuase not only do they want to do away with fair use but doctrine of first sale and they want to renage on their end of the AHRA (You already paid to make mix tapes and mix CDs if you purchased any media ir recorder that has the royalty built in - HINT CDS MARKED AS "AUDIO CDS" CARY THAT ROYALTY DUE TO THE AHRA)

The media companies also want to tie content to specific device- Sony in paticular is guilty of this. In the case of SONY they tie their own content to a special format that only plays in their players. Nothing inside of copyright law allows this except the 1201 provision on access controls. The set of exclusive rights found in section 106 does not allow this.

The content companies on the otherhand are pushing for laws that ban devices to produce content, if you read the analog hole bill it will be ilegal to sell any popular device that has the capabilties of procesing video over 350,000 pixels (less than a 300 X 100 resolution). If we allow DRM to flurish not only will we not have any rights and will have to pay each time we Play or View or Read or Run any copyrighted work but it will kill amauture/small video artists. This is of course what they want.

If the politicos don't want to pass the DMCAr then they shouldn't be passing other legislation either... excpet that the RIAA/MPAA wants this legislation passed while they don't want the DMCAr passed. Draw your own conclusions from that.
