So what harm is there in legally allowing circumvention for fair use?

Nobody really cares if you engage in fair-use infringement [1]. What they care about, greatly, is that there be no exceptions to 1201(b), which outlaws "circumvention devices," including even talking about them.

1201(b) gives the Content Cartel the power to dictate whatever terms they like to equipment manufacturers. For instance, a maker of video decoder chips used in 100% legal video players was recently sued into submission with the Court ordering them to only sell those chips to companies bound by a DVD-CSS contract. Those contracts have a lot of provisions that have nothing to do with copyright protection.

There's a lot at stake here, and copyright is just the pretext being used for a land grab.

[1] Oh, all right. The Content Cartel would prefer not giving up even that much, but frankly it's not worth enough to them to fight over.
