I worded that
quite carefully, and I'm quite sure it's illegal. By saying 'expressed purpose' I mean the provider KNOWS that the product will be used to violate the law. That's different from what the court ruled on. Precedent is well established on that issue.

As a provider, if you knew (or should have known) that your actions were directly and expressly facilitating a crime, you can be found guilty as an accessory to that crime. It's worth pointing out that the crime has to be a specific act. Chances are that a gun shop owner will, at some point, sell a gun that will be used in a crime. He is not guilty, however, unless he is abetting a specific crime. There's also the consideration of whether he acted in good faith and followed the law before selling the firearm. If, for instance, he sold a hand gun to someone who didn't have a permit*, regardless of whether he knew the gun was going to be used in a crime, he can still be charged as an accessory to that crime because he committed an illegal act.
