Interesting philosophical question Bit. You seem to be in
favor of doing things this way (see also your comments on
the RIAA lawsuits), make a public example out of a few
offenders, which will then frighten off any other possible
offenders.

I have to question the efficacy of such an approach.
Clearly, it's not working for the RIAA. Would it have
worked for MS? Certainly not in this case, as the bad PR
generated can't be worth the time and money they could
have spent to get out of this.

It reminds me a bit of a University I used to work for. The
big public school across town was constantly wracked by
scandals--cheating, sexual harrassment, things like
that--which always made the papers, caused problems for
the administration and faculty, and gave the place a black
eye. The private school where I worked very quickly and
quietly settled any such matters, and kept them out of the
public eye. And as such, the private school had a vastly
better reputation with the public.

Sometimes it's just not worth it.
