And was promptly broken again
Every time Apple fixes FairPlay to stop JHymn, JHymn gets
updated within a few days to correct Apple's fix. Every single
protected track Apple has offered has turned up on p2p
networks. All it takes is one person to do that, and then all the
DRM spending was a complete waste of money.

---Of course the real problem is that Apple implemented it with
software instead of in the hardware. I believe that will
change.---

I don't see Apple doing much as far as altering the hardware of
their iPod. Why bother? The customers are happy with it and
the RIAA is happy with it. Where's the profit in changing the
fairly happy compromise that has already been established?
Remember that Steve Jobs himself has publicly stated that DRM
is never going to succeed, and that it's only there to placate the
RIAA, that it has to be so invisible that the average customer
doesn't even notice it's there, and that you don't win the game
by restricting the customer, you win by out-competing
everything else that's out there (including the free services).
