No License to use
It's a license to copy. Still the concept works the same. See in order to download you must make a copy. If you want to listen to it from a copy on server you must pay for the broadcast some how. Either user fees, fees collected from advertising or some other scheme.

When you buy a CD you buy the work and you own it. No copying need and under fair use you do have some copying. When you buy online you buy the right to copy the song under terms of what ever license you agree to.
