And you call all the drivers in the Indy 500, except the winner,
losers? It's one race in a season of many races, in one season of
many seasons in a career.
The difference between the example you provide and patents is
that with patents only a few teams (with patents) would be
allowed to compete setting a barrier of entry to new entrants.
