As I noted in my other post to you...
...Linux isn't sanctioned as official Unix by the Open Group, the supposed arbiter of what constitutes proper Unix. It would be foolish to pretend, though, that Linux is so dramatically different from offically-sanctioned Unix that any comparison is useless. Linux, clearly, is in the "UNIX" domain, whether or not some official body rubber stamped Linus Torvald's forehead.

As George Mitchell pointed out, open source as a term existed long before the OSI declared itself the arbiter of what is considered open source. This bears strong resemblance to the battle over the name "Windows."

open source is a concept that has many instances. It is NOT something owned by the OSI.
