You can't be arbitrary
When you're dealing with specific concepts.

The fact that open source (little o little s) is a phrase that may or may not have a particular meaning is irrelevant when your discussion is really about Open Source (big O big S) which has a legal definition, a service mark, and an entity that manages it.

You're trying to play word games when there are actual legal definitions for the items that you're discussing.

I could argue that shared source (little s little s) means something radically different than MS's Shared Source (big S big S) and thus make whatever point I'd like to with it.

This isn't a matter of what the words open and source mean to you. This is covered by what the legal definition of Open Source is.
