I can't agree
This is the logical fallacy that I'm trying to avoid with word games over what the "absolute" definition of open source is. It's like saying the following two things are COMPLETELY distinct:

- Maslow Cars: We offer cars that are yellow, have thick rubber bumpers, and chrome trim.

- Jaslow Cars: We offer cars that are yellow, have thick rubber bumpers, chrome trim and are driven by a woman named Mary.

I would suggest that the differences between Shared Source and Open Source are fundamental and not simply in the details. If you look at the raison d'?tre of Open Source, I would suggest that it is very different than that for Shared Source. If we must play the car analogy game, I would say:
- Maslow Cars: We offer cars that are yellow.
- Jaslow Food Processors: We offer food processors that are yellow and are used by a woman named Mary.

Just because they are both yellow doesn't mean that they are at all comparable.

"open source" is a general term NOT owned by the OSI.

I agree. However, even if you want to get liberal with the definition of "open source", I don't think that Microsoft's shared source is a match in any way other than "you can see the code".
