Are you talking the language or the frameworks. Whilst c#
language is a standard, it is nothing without the rest of the
.NET frameworks.

.NET is neither available without license fees or without
strict MS oversight (actually 100%).

You can package your own Java libraries (eg IBM's SWT)
without Sun's permission, just that it won't become part of
the JSE standard approved by the Java Community Process
(JCP). This is all mono is doing, two frameworks a .NET
clone and a GTK+ framework for developing GNOME apps.

So Java is currently way more open than .NET (via JCP).
However, many would prefer a GPL version of a JSE
implementation to encourage inclusion in GNU/Linux
distributions. This is what IBM an others are asking for.
