Didn't Caldera try that once?
At one time, they attempted to make their old Unixes (allegedly purchased from Santa Cruz Organization) compatable with linux binaries. Then Caldera renamed themselves "The SCO Group", and things went downhill from there.

What scares me is the following scenario for Sun...
1) Pseudo-open-source Splaris
2) Wait a while as the Solaris code gets widely distributed
3) Claim that lots of linux code is "mentally contaminated" by programmers looking at Solaris source
4) Lawsuits???
5) Profit???
