"Yes, it is a document about DMCA circumvention, and legal permission for that. But the RIAA statement goes well beyond that.

During the Grokster case, MGM said in court that ripping a cd to an iPod was legal and was a fair use right. Here, they go out of their way to bring that up again and try to change the meaning of that statement, so it says, that was just an example in that one case and was not, in any way, a statement that ripping should be considered legal or fair use. Re-read what they have said, it's not that you can't rip a copy-protected cd, it's that you can't rip any cd unless the rightsholder has given permission:

"Nor does the fact that permission to make a copy in particular circumstances is often or even routinely granted, necessarily establish that the copying is a fair use when the copyright owner withholds that authorization. In this regard, the statement attributed to counsel for copyright owners in the MGM v. Grokster case is simply a statement about authorization, not about fair use."

Witholding authorization could mean copy protection, or it could just mean them saying "no"."

Read the title of the document for proper context.

"What if the copy protection is Windows only and I use a Mac? Can I then make a copy? I haven't circumvented anything, at least not deliberately. That's why they're shooting for a bigger prize here, the ability to deny anyone, regardless of equipment, the right to make any copy at all, without their permission."

Fair use is available if technically feasible. Too bad you cannot play your CD on the first CDRoms that came out. Next you will complain you cannot rip music off of a Edison Wax cylinder player.

"Again, that's not what they said. They said "no authorization, no copy". Doesn't matter if your equipment will let you or not. Space, format-shifting and backup copies are not fair use according to their statement, regardless of the media or if there's any copy protection."

Again, read the title of the document for proper context.

"Recording media would still be legal for your own creations and material in the public domain. And I'm not taking it out of context. The RIAA is taking a very public stance here, and it's probably a smart one for them. They're saying that no copying is legal, none at all. A court will, of course, whittle that down, but it would be stupid for them to do anything else than shoot for the ultimate prize, the ultimate control over everything."
