Not really. It is on copy protected media. Not all media, like the EFF is saying.

Within the limitations of the player. DRM prevents unauthorized copying and the DMCA law overrules all previous laws. Fair use is dependent on the capabilities of the player. A ROM drive doesn't abuse your fair use rights because it is incapable of making backups. So neither does the DMCA. DMCA is part of the firmware and sets up the parameters of the drive.

Will not happen. They know that exceptions are abused. As for fair use, it is completely dependent on the hardware's capability. Also fair use is no guarantee that your media will play in everything. Fair use is basically, if you can do it physically, then you are allowed. Take away the capability, and fair use has not been violated.
