In order for the market to set the price...
There has to be a competitive market. This doesn't mean that a monopolist or the members of an oligopoly have an entirely free hand, but you can't really claim that the market sets the price if, as is commonly alleged, Microsoft Windows is a prerequisite for the effective use of one's Intel-based PC (the implication being that any PC owner who doesn't run Windows is either a fool or an ideologue).

If everyone needs MS-Windows, you do not have a competitive market and MS can set whatever prices it wants, as long as they aren't so high as to encourage either illegal copying or the development of a competitive market. That's a lot of leeway, particularly if you actively "participate in the political process", to use the popular euphemism.
