The only advantage they have is that people can't see all the patents they are violating. They face the same risk of "violating patents they didn't even know existed" with each line of code.

It can't be that long before some enterprising lawyer points out that they don't have the right to keep their code secret while they are obviously violating patents and they are forced to reveal their code.

Proposed patents need an OPEN review by the community after they have legally secured the inventors rights and before they become a full patent. There is often plenty of prior art for many "new" inventions.
