That's not actually the argument being made (at least, not by any Republican I've heard so far). The argument isn't that we can't be sure who he was talking about. The argument is that it's illegal to reveal a covert agent's identity by name, while they're undercover. Present indications (as far as I'm aware) are that Plame (aka Mrs. Wilson) hadn't been a covert operative for 9 years when Rove had his conversations w/ Cooper. if that's true, then he was not in violation of the law. Additionally, to be in violation of the law, the CIA would have had to have been taking steps to conceal her identity. And lastly, he (Rove) would have to know that she was a covert agent at the time he made the revelation to Cooper (or anyone else he talked to about it).

So you see, the prosecutor would need to affirm several things before Rove could be indicted on that charge. Anyway, indications right now are that Rove isn't even under investigation (by anyone in a legal capacity, that is).

As I said before, if it turns out Rove told the special prosecutor he had nothing to do with talking to Cooper about Plame/Mrs. Wilson, then he could be brought up on perjury charges, which is a whole different kettle of fish. But it looks as if the leak itself doesn't put Rove in legal peril (as the information stands now).
