Depends on when it was filed...
A patent is a patent, and is meaningless unless enforced by the inventor,licensee.. and by that, court order if ignored when the inventor comes calling.

So, if someone came up with that idea many moons ago, and it was patented, the inventor gains protection from others creating the same work for 20 years from the date of the application.

The title means nothing, its content of the patent itself, not even the abstract should be read or treated as worthy of discussion because its the CLAIMS that matter.

Sorry to say, but there are a lot of people jumping onto the bandwagon of "down with the PTO" when it isn't the PTO's fault that there are so many people claiming to come up with something new, providing the funds to an attorney to put together a patent, and then the long wait [18 months for it to be published, and still it hasn't been reviewed, 6 months later, still nothing... they are backed up by 2+ years just for review, then comes office actions, and you can change your patent as I have witnessed first hand to something completely different]

There aren't enough agents moving thru the patent applications, and therefor something that WAS new and non-obvious has become that over a 2+ year timespan.

There are occassional slips, but thats the sad part of human nature taking advantage of a known flaw in the system, not the system. We shouldn't have locks on our doors, but we do because people like to steal other peoples stuff.

Patents protect against that.
