Many states break their sales tax in differnet ways. Some do not charge for labor, only hard goods sold. That puts it on the sellers back to determine if the product they are selling has any labor in it and a percentage.

So, you are selling software via download. There is no tangible hard goods, it's all labor. But at what point does this become not true. It takes as much labor to write an app and sell it once as it does if you sell a million copies.

The labor was paid for at some point, so what should the tax rate be? Who is going to set that value? Who is going to track it all?
