Adware vs Spyware definition
I would suggest that the definition is quite easy, unless one is trying to skirt the issue itself:

Adware is invited materials received due to an active user visit to the site with no remaining data collection or actions once the user has terminated their visit.

Spyware is uninvited materials received due to an active or inactive user visit to the site with any remaining data collection or actions once the user has terminated their visit.

This defines the two key issues - active chioce of the site by the user and post visit actions by the software.

However we will insist on massive committee strcutures and endless discussion to codify the obvious.

That is why industry can never police itself as vested interest always clouds the basic principles.

My two cents in this debate for those who really just need a definition to live with !
