"1. The RIAA *legally* owns the files being swapped by millions on a daily basis."

No, they don't. The own the music that the files are interpreted to represent. The RIAA does not own the very long sequence of 1's and 0's that constitutes the "shared file". When you look at file sharing in a technical sense, copyrights don't fit or seem to actually apply. They only thing you are sharing is how a small part of hard disk is magnetized, so someone else can magnetize a small part of their disk in the same way. That part of the disc can be interpreted as music in MP3 format and you hear the song, or it could be interpreted a billion different ways with differing results. Now copyright is applying to particular way that the 1's and 0's are interpreted, yes that file could be read as an MP3 of a copyrighted song, it could also be read as an encryption key for my secure files.

My suggestion for P2P networks and the people on them, convert the files you are sharing into a format that cannot be interpreted as music until it is converted back, that way no copyrighted content is really ever shared.
