Good discussion btw, too bad these forum layouts suck!

Having to travel to a store and hope that they have the one song you wish to sample set up in a listening station is not convenient, and has a very high failure rate.

All the stores around here let you pick any CD you want in the store and listen to the whole thing if you want. There are some that are pre-setup but you aren't limited to that.

If this is the case, then why were cd sales at an all time high when the original Napster was in business? I'd argue that it exposed people to all kinds of new music that they could readily sample and then purchase.

You could be right but just because sales were increasing does not mean that "infringing" didn't have a negative effect. It could very well be that the industry as a whole was increasing rapidly for reasons unrelated to Napster and that Napster stopped it from being as big as it could have been.

I would also contend that when Napster was at its height, the broadband revolution hadn't quite taken off yet. Spending 24 hours to find and download a full album on your 28/56K modem was a huge pain, especially since it tied up your phone line. I would contend that the environment is different now when it takes a matter of seconds to download a 128kbps song and even if it takes longer, you still have full access to your phone.
