You are rigth: so with your kind if logic applied we should get everyone in court that makes things that could be used to commit a crime. Like clawhammers (used in many break ins) cars(used as a means of transportation for a number of criminal activities) Compilers and programming tools(used in hacking protected software), OS makers like MS, aplle and others for providing an OS for the computers used in these crimes.
