Who gets to make the list?

That's a good question. It appears that the state AG gets to make the list. I guess there is a sort of electoral oversight, but in a conservative state like Utah, I doubt that many people would worry about a list being too restrictive.

Of course, the customer has the option of simply not requesting the service. On the other hand, I am in favor of minimal government, so the idea of the government mandating this is bothersome. Besides, there are already ISPs in Utah that do this, such as Mstar. (http://www.mstar2.net/preportal/) Ultimately, it appears that the government is demanding something the private sector already provides, so I am opposed to this.
