It's legal for now
Russian officials have stated that while it violates the spirit of the law, it does follow the letter of the law, so for now, it's legal (expect the laws to change soon).

However, there are lots of legal and DRM free options, like ripping from your own cd's, buying directly from artists like http://www.tmbg.com , getting free downloads from places like Amazon and from artist web pages, buying from Magnatune, etc.

I've always been a bit dubious about buying from allofmp3, as they seemed pretty aware that they were dodging the law from the get-go, and I figured that wasn't a good group to share my credit card info with. Though many have reported good results from them.

As to the orignal question, I do occasionally use the iTMS, because it's really convenient, and the DRM doesn't prevent me from doing anything I want to do with the music.
