You would punish the wrong people
Your 1st sentence proved your idea was moot.

So you want to punish people that would upload their work to their employer. How about all the people maintaining a website? You would punish your buddies colaborating on free software.

Your computer may be in server mode but mine was turned off from day one. File & Print sharing is verboten on my machine.

Your ISP could have speciality software that would know your MAC address, IP#, number of up & down streams on which port# and log it for the month. This puppy would be listening on 65535 ports. You will use a protocol approved by friends of management, when using p2p or you don't play.

Nobody would like your solution. Web is a two way street.
