---I am all for compensating the creator but how long should we do so?---
The Constitution calls for a "limited" period, so it's not spelled out for us what that means. I think trying to force short terms through will be fruitless, given the power of the lobbies involved.
To me, the first step is to release all the orphaned works. Lawrence Lessig has a plan for this on his blog. Basically, you get X number of years for filing a copyright. After this, you must renew it for a nominal fee, and you get the full Sonny Bono length copyright. But if you don't, it goes into the public domain. Right now, Congress is collecting comments on this proposal, and has posted many examples:
