Letter of the law versus the spirit of the law
That's exactly what's going on here, allofmp3, while violating the spirit of the law, has not specifically broken the actual letter of the law. So for now, they're legal. Expect RIAA money to finance a change in the law in the near future, since the money they've spent to prosecute here has been wasted.
