Pursuing a dead case is kind of a waste of time
It's obvious that the problem is not what they are doing but what the law allows them to do. Wouldn't it be smarter to push for a change in the law to close this loophole? Why waste your time beating a dead horse. The prosecutor obviously knows they can't win this case with the currently as is. Pursuing this further will just make that law stronger as judge rules on it as fair as written. That's all a judge can do, they don't make law they just interpret it as it is written. If it's a poorly written law then tough luck, go re-write the law.

This is exactly what happened in Canada when pot was legalized for 9 months. The courts ruled that law could be bypassed as it was written and told the House of Commons to re-write or remove it from the books. They chose re-writing to close that loophole.
