Not exactly true. You can burn them to CD and play them on any CD player. You do not have to buy any Apple product to use the iTunes music store. All you need is a Windows or Macintosh computer with the free iTunes software.

Nearly all the content on the iTMS is available from other vendors in other formats.

Whilst I think the suit has some merit from an academic standpoint, in all reasonableness I think it's doomed.
