Think you are missing the point as usual John. If Google 'sold' the adword 'Microsoft' to a competitor so that the competitor's products would ALWAYS show at the top of the list.... I'm sure Microsoft would sue, too.
The fact is when a consumer searchers for a KNOWN BRAND, we expect to FIND the BRAND NAME. Not some cheap knock off or fake.
