When a law is unenforceable and a majority of the population break the law the law in invalidated.
I disagree. I would hazard a guess that the majority of the population has broken the speed limit at some point in their lives. Just because no one is under the assumption that you can give EVERYONE who speeds a ticket doesn't mean that you shouldn't ticket the ones you catch. If you get caught often enough, you lose your license. I see the same thing happening with P2P. The RIAA/MPAA won't ever go after the person who shares a song here or a movie there and if they try they will quickly go bankrupt. The ones they catch though will be punished, just like you would get punished for speeding if you got caught.
I think even evidenced here on these message boards your view is of the minority.
That's okay, I look at the majority of people and I'm glad that I don't have the same beliefs they do.
So that's your majority. Now how easy is this law to enforce. Well not one single case has gone to criminal court yet. A few thousand have been threatened with civil cases.
Just because you haven't broken a criminal law doesn't mean that you haven't broken a law. Like I suggested above, I see this like a very expensive speeding ticket. You won't get thrown in jail but it will cost you money if you are caught.
Copyrights have gotten out of hand and now this one of the results.
I wonder if you are confusing patents with copyrights? I agree that patents have gotten out of control but I don't think that the copyrights on music and video have changed that much, have they? I think what HAS changed is the belief that you can get away with "infringing" music far easier than you can get away with "stealing" a CD from a store. The majority of people never had respect for the law, only fear of the consequences. Now that that fear has been removed, things have gotten out of hand and now this is one of the results (if I may quote a wise man
).
