Technology can advance in 2 directions
If they attempt to go after the P2P networks on which infringement is occurring, people complain and the technology just advances further, making enforcement harder.

I would hope (perhaps naively) that technology advances to make identification and removal of infringing material easier. Invariably it is going to boil down to 2 types of sites: those whose primary purpose is to distribute infringing material and those who have legal intentions. The only thing that will ever stop the 1st group is legal action. Banning software will NEVER stop them. If they are willing to break copyright laws, they will happily break "banned software" laws. Unfortunately, scum like them are a reality in this world and part of the profits that the RIAA/MPAA collect will have to be used to punish those criminals. If I was part of the 2nd group and I wanted to distribute open source software, or patches on my P2P site, it would be in my best interests to keep infringing material off my site. Not only does it attract the attention of organizations with enough money to sue my pants off, it is a waste of bandwidth and it clutters up file lists. At that point, technology will emerge to solve the problem.

Even if the technology can't automatically remove ALL infringing materials, it could easily help support a (possibly manual) process where infringing materials are identified and removed from the site. I believe that the RIAA/MPAA have gotten to this point of desperation not because infringing materials exist on P2P sites, but because site operators have done nothing to help remove the offending materials. Google is a perfect example of a responsible company that removes links to infringing material when asked. I think the fact that many P2P site operators specifically refuse to remove infringing materials shows that they know their sites are used primarily for illegal purposes but don't want to lose the "clientele".

If they try to go after uploaders, people complain about privacy and anonymity.
People can complain all they want, it doesn't make what they are doing any less illegal. I can't break into your house and then complain that my privacy and anonymity has been violated because you found my fingerprints and tracked me down. I say tough to those that complain. If you don't like it, don't "infringe".
