guilty of...
ok, but lets say he pleaded guilty and the can spam act describes punishments for each type of action considered under the can spam act. ok, under the can spam act, whats the fine for stealing names from an isp and selling them? i dont think thats covered. at least if it is, i skipped it. he should have been charged with theft and or something else to get a plea bargain. the judge merely is looking for "if he is guilty of violating the can spam act, then what punishment do i impose?"
if i break into your home and take a picture of all your stuff. then i sell the pictures to thieves who then go and steal your stuff. im accused of stealing your stuff and the evedence shows i merely took pictures of it and gave those away, then i plead guilty to stealing your stuff, then i would be set free. due to the fact that the evedence shows i didnt steal anything, i broke in, but i wasnt charged with that. others stole your stuff, so i didnt do that.
thats how im understanding this whole ordeal. and if he was stupid enough to sell the list for a measley 100,000 and the prostitutors were stupid enough to charge him only on a law that doesnt cover stealing usernames then its all a crock. a mockery. put the damn commandments back in there and quit focusing on irrelevent stuff. but it looks promising. if i ever do something stupid and get blamed for something else. w00t!
