If the language doesn't include penalties/violations for this type of action, then he can't be charged "under the CANSPAM act."

He is probably guilty of outright theft and criminal trespassing though, both of which can carry substantial fines.

The fault here lies with the prosecutorial process and why they chose to use CANSPAM in the first place. My gut tells me they were going after the spammer who used the list and this guy was a by-product.
