You presume too much...
Your entire harangue is based on the assumption that what he did violates the letter or spirit of the CAN:Spam Act, under which he was charged. If his actions do not fall under the Act, then no crime was commited thereby. That's not to say there aren't other crimes of which he might be found guilty, but CAN:Spam may not be one of them.

To find him guilty under CAN:Spam when the charge is inappropriate, the judge would have to, in effect, write new law. Do you want the judge to "write new law" simply to reduce crime?
