MarketScore - Spyware in my oppinion
I work in computer and network support. I have had to remove MarketScore. It follows many characteristics of Spyware -- even without looking at the fact it tracks data.
It is not simple to uninstall. There is an uninstall, but it is a hidden command line utility.
There are different varients of it, when they changed the name of it (probably when a spyware removale utility found it)
It alters a system file. (TCPIP) Which means if you uninstall it properly you may render your system useless (on the network/internet)
If that doesnt scream spyware at you, I don't know what would, however all the users I remove it from said they were unaware they had it and had no idea where it came from or what it did. Therefor it may be voluntary - but they do not make it known. If it is truly vonuntary, the install/uninstall should act as any normal program (MS Office, mozilla, etc)
