a winner of a legal judgment can legally seize assets from the loser if the loser doesn't pay voluntarily at first. assuming the winner knows how to do so, or hires a 3rd party judgment collection firm to do so on his behalf. as most of you realize, just because you win a court judgment does NOT mean you'll collect.

depending on the state of the loser, declaring banko may shield some assets from seizure.
but as others have already commented, this process won't stop the loser from reopening elsewhere under a different company name.

and as far as i know, throwing someone in debtors prison went out with charles dickens.

now, if the loser can be found guilty of some criminal act that includes jailtime....
