Interesting to see how this holds up
Previous efforts to pin charges against BT/Edonkey site operators has failed, because "technically" (not ethically), they are doing nothing wrong. They are simply hosting hash identifiers, and not the actual files themselves. Further complicating the issue is that fact that BT and Edonkey users don't download the entire file from a single user, and unlike Kazaa, the file isn't in any usable state (ignore the Preview functions) until it is completely downloaded, so really, what is being downloaded is just meaningless bits of data, from multiple sources in such a way, that it is almost impossible to download every single bit of a file from a single user. Basically that means, that at least in the U.S., since a user isn't techniclly sharing the "entire" song, just parts of it, it really doesn't meet the requirement for copyright infringment, as currently defined by the US courts. It should be interesting to see what comes of this. Both are incredible technologies, when you actually get down to examining them.
