Software patents can actually kill the entire process of upstarting, in some cases. The up-start has a great idea and takes too long to get it marketable. By then, MS or some other major player puts out their version of the same process and boom, the up-start doesn't even try to compete. They just hire a lawyer and sue for rights. Many people having the same idea during the internet boom was common. Everyone saw where it was heading and what could be done. I'm not saying MS is an angel by any means but, sueing MS is an entire business within itself. IBM, MS, and others must have a massive team running through all of their previous nuggets and applying for patents on every little snippet to defend themselves. Then you can't even write a for next without infringing on someone else. Where do you draw the line? The courts must start deaming the majority of these suits a frivilous and dismissing them. That will set a precedence and set the stage for removing software patents.
