Software Shouldn't Be Patentable
We've all talked about this before... When is the legal system (and the patent system) in the US going to wake up? If you and I have a conversation, we may say unique things. We may record the conversation and others may want to hear it replayed, for various reasons. But we can't then go on to patent the sentence structure we used, can we? The patent office would laugh in our face. So how in h-e-double hockeysticks can anyone patent code that is just like a conversation, except in a computer language? It's ludicrous. The language shouldn't even be patentable, so how can what you say in the language be patentable? Where do you draw the line? Copyright should be the only legal structure applied to code replication. And if someone develops a similar process on their own from scrath, then it's theirs to use as well. This whole patent foolishness is just a blind on the part of the big companies to crush the little-guy "upstarts" with their dynamic new ideas and drive to succeed. Oh, and of course, the big companies will lkely win. That's the way of things, right? The poor get poorer and the rich get richer. There's your American "Dream" - nice.

You are 100% spot on. Copyright is meaningless to software.  No_Ax_to_Grind | 12/10/04
