Proving a negative
---You simply don't know that---

As you've said regarding this case, proving a negative is very difficult. The RIAA has made the positive claim that filesharing is damaging their sales, despite all evidence to the contrary. Until they provide evidence that backs up their claim, I refuse to believe it, as any thinking person would.

---And that is why I am saying a metric shold be built into the code to provide real information instead of guesses---

What good would this do? If you knew the exact number and names of every file being illegally shared, how would this prove a financial loss by the RIAA? Can you prove that all of those sharers would have bought the cd if they couldn't infringe and get it for free? Can you prove that they haven't since gone out and bought it after downloading it and listening to it?

CD sales continue to rise despite filesharing. There's really not much more to say beyond that as far as economic damage goes.
