Ad-ware/spyware folks forget--I OWN THE COMPUTER
I find it unreal that the marketers that are using spyware and adware fail to realize that as related to my personal computers I OWN THEM, and the computers at the law firm, for which I am Director of Technology and Research, OWNS THEIR COMPUTERS!! I have have every legal right to control what they process, period.

These adware and spyware companies hide in the shadows of the computing world and exploit access for "personal gain!" (If they were not making money, they would not be doing it.) Their adware and spyware uses computing time slowing down my systems,and uses internet acess for which they do not pay and slows down my access.

In the process they are stealing processing power and internet access. That is a theft of services, in the State of Tennessee! They may claim that permission was given in some obscure fashion, but that does not meet the legal standard of INFORMED CONSENT!!!

We have a large corporate client that has asked the firm to litigate these adware and spyware companies for theft of services and for the costs relating to removing their spyware, and other damage to the desktop systems and servers, for the cost of internet access, AND the cost of blocking their crap. It appears they may be on very solid ground in both the courts in Tennessee and Federal court.

It is time for the Federal Trade Commission to address this in some way as to regulate and control this. It is no different than someone gaining unauthorized access to the computers and networks involved. For permission to be granted it must be INFORMED consent in a clear and understandable manner, not hiding in some puffed up permission or latching on when a certain web-site it loaded. It is time for this to stop. The only way to stop it is to make it as unprofitable as hell. In the case of syware and adware litigation for theft of services may be the answer.
