Or the user is sued and held liable?
Hmmm, user installs an application with spyware. Buried deep in the EULA is an agreement he/she will do nothing to remove any included spyware. Following week he installs a spyware removale app and that EULA grants them to remove anything that looks like spyware.

TIME TO SUE THE USER!!! After all, we are out $10,000 every day!
